What's the difference between ear-bud and handsfree as regards a safer motoring environment ? You still have to press an 'activate' button if using voice dial on either system ! After that there's very little difference. What if I selotape my mobile to the dash and use my earpiece to talk/listen . . does that make it a 'fixed hand-free unit' ? What if I go deaf and have to start wearing a hearing aid . . can I be charged under the legislation for unsafe driving because I have a yoke in my ear ? In reality it should be an offence to use the phone whilst driving . . . but people who invested in their own and others safety by purchasing any type of handsfree kit should not be singled out to the same extent.
