If the computer repair shop is a reputable one then any software they put on there would have been legitimate.

If the "upgrade" involves completly replacing the old software then there should be no problem. But if its just an upgrade of say Windows 98 to Windows XP then you need to check that the original install was legal

If you have the original CD and "installation key" (a 25 digit code) then its okay.
