I disagree. If people were given assurances that all details of meetings between them and the lawyers would be treated as absolutely confidential, why should someone else come along and change that agreement? If you went to a solicitor and told your story, whatever it may be, you are covered by lawyer/client confidentiality and your lawyer can not under any circumstances disclose what was said. If it happens that another lawyer takes over the case, he or she can not change that rule. That is what is at stake here. Cardinal Connell (not O'Connell by the way)said that he must protect the victims who suffered by refusing to disclose what was said in private to their lawyers. It is strictly a point of law and this time I agree with him.
I can tell you that if I as a victim of abuse, gave my evidence or told my story in private to a solicitor and was guaranteed that what I said would remain confidential, I would not be pleased to see another person come onto the scene who would waive that case of privilege.
