It's happened already but the guy who 'owned' the gene didn't have his name on the patent. A doctor/scientist treating this poor unfortunate for a rare disease patented some of the patient's DNA. He lost the case to reclaim his own DNA in the USA and was lobbying Europe to try to make sure that they didn't go down the same path. For a long time in Europe you couldn't patent a living organism. But no longer.
