I’ll save you the time Tuars. No court is going to find the Finance Act in breach of any constitutional provisions for a number of reasons:

Firstly, the Finance Act 2000 will be what is termed a ‘Money Act’ in that it raises money for the state. Courts are reluctant to hold such provisions in such Acts unconstitutional without over whelming evidence to the contrary. No matter how good or well grounded your political or moral beliefs in this area are, they do not amount to such evidence

Secondly, all this stuff about pledging to protect the family and women is aspirational. It is what the State aspires to rather than guarantees.

Thirdly, whatever economic argument for, or against, the provision you or anyone else will put forward, for, or against the provisions, will always have an equally compelling counter argument. The provision would neally have to amount to persecution of families/women.children etc to warrant striking down.
